    Digital Copy Copyright Question

    Aside from all the debate about whether flea-market vendors could/should/would be allowed to buy multi-format versions of movies, and then sell the digital code at their respective kiosks, I have a similar question.

    I have a friend who likes buying the multiscreen version of movies because he likes having both DVD and Blu-Ray. He's old school and knows nothing about streaming digital copies, and isn't really interested in learning. He gives me the digital copy leaflet when he buys a movie because, to him, its just a slip of paper that he'll never use.

    I have begun noticing a "non transferable" notice on multi-screen movies, and was wondering if him giving me the digital code is, in any way, some sort of copyright infringement. It shouldn't be. There's no copy being made. It is bought and paid for. Does it mean that for every digital copy I redeem from a multi-screen purchase, I should have the corresponding disk to show for it? In short, is his GIVING me the digital code legal?

    And, just for laughs and giggles, would the answer to my question be the same if he were giving me the disk and keeping the digital copy for himself?

    First sale doctrine applies. He can give you any item from a bundle that he chooses.

      Okay, so what does all this non-transferable business mean then? It is on the labels. For example, the SOLO movie has the explicit statement, "CODE IS ONLY FOR PERSONAL USE BY RECIPIENT OF THIS COMBINATION PACKAGE OR FAMILY MEMBER". So, if I read that right, only the owner, or his immediate family, of the combination package can use the code. Giving the redemption code to a friend is a no-no, in stark contradiction to the First-Sale Doctrine you cite.

      Why would Blu-Ray manufacturers print something on their labeling that is contrary to current law?

          Disney is taking the hard line here (what a surprise) due to it's legal entanglements with RedBox over selling the combo package codes. Disney's argument is that because the actual digital copy DOES NOT EXIST before code redemption, that it is not covered by First Sale Doctrine.

          Disney has also revised the wording on both their redemption site, and Movies Anywhere to read:

          "FOR COMBINATION PACKS: Digital codes originally packaged in a combination disc + code package (for example, a combination package that includes a DVD, Blu-ray, and/or 4K/UHD disc(s) and a digital code) are not authorized for redemption if sold separately. By redeeming one of these codes, you are representing that you, or a member of your family, obtained the code in an original disc + code package and the code was not purchased separately. Your representation is a condition of redemption of the code and of your obtaining a license to access a digital copy of the movie. To read all terms and conditions applicable to using your Movies Anywhere account, click here. If you agree, click the REDEEM button above."

          Disney is doing it's best to get a stranglehold on second-person purchases of digital codes, and also trying to lead the way in cloud-based digital ownership. If they only realized they are shooting themselves in the foot by implementing an "every penny we can squeeze policy" regarding their titles because there is quite a percentage of these digital copies that would never be used by the original purchaser. Conversely, there is a decent percentage of discs that would never get sold if there weren't a secondary market for the digital codes.

            But what about when a friend, who doesn't plan on redeeming the digital code, just gives you the leaflet?

              No one is going to arrest you, inquire where you got the code or even give a hoot about it.

                Only receive those leaflets under the cover of darkness, like a poorly lit alley. After the leaflet is in your possession, you sneak quietly out one end of the alley and have your friend sneak out the other. All's good!!!
