Amazon Kindle Fire HDX and Vudu HDX

With Amazon's new Kindle being HDX, does that mean it's video content is in "HDX" quality instead of "HD" quality? If so, how will it compare to VUDU's HDX? Will the Kindle have a Vudu app?

Vudu is so big as a UV streaming provider people don't understand this:

"Vudu is capable of downloading and playing movies in HDX format, a format created by Vudu which encodes titles in 1080p HD at 24 frames-per-second."

Amazon calling their Kindle HDX just confuses the term HDX. People also ask for HDX format when trading or buying UV codes not realizing HDX is a Vudu format and not an industry standard.

Personally I think Amazon using the term HDX is a smart move by them to steal some of the thunder from Vudu or confuse the consumer into their service.

As for Amazon having a Vudu app, don't count on it as they are competing with other streaming providers for your dollars (Vudu included). There is a way to get the Vudu app on a Kindle but I can't say how in this post.

Don't you think that since HDX is Vudu's then with Amazon using the HDX in their description of their tablet and possibly doing what you mentioned they probably are trying to do, will open them up for some infringement claims ?

How about Home Depot and their line of HDX products.

Well, the Home Depot products are very unlikely to create customer confusion; they are totally different product categories. I think they might have a case with Amazon using HDX, because in this case Amazon is basically using HDX as a way of saying "better than HD" (last years Kindle HD), albeit for a physical product, rather than a compression method. Either way both are closely related to streaming video. It is possible that HDX is simply too generic for Vudu to have trademarked.

You make a good point that infringement generally needs to be in a similar line of business in order for it to cause confusion, despite what Monster (tm) Cables might think. I don't know if hardware being called HDX is enough to create that confusion, although they are very craftily using "HDX" to refer to its resolution. I know that when I hear HDX, I immediately think of Vudu and 1080p video...but then we're all a lot more familiar with Vudu than the average consumer.

I'm no lawyer and I haven't seen any trade marking by Vudu for the term HDX. Having said that, I was merely making the point that Amazon is helping their Kindle line and streaming service by using a term people associate with high quality streaming. Remember when Amazon was being sued (and won) by Apple over the term "appstore". I'm sure that helped the Kindle brand in some small way as well. Give credit to Amazon for taking advantage of an established term but remember this; HDX is simply (in terms of video streaming) a format created by Vudu for 1080p. This is no different than Netflix calling their 1080p format "Super HD" but that sounds stupid to me.
